Ride/event waiver

By submitting this form, I acknowledge I have read, understood, and agree with all of the information presented on this waiver.

ACCIDENT WAIVER AND RELEASE OF LIABILITY

I acknowledge that by signing this document, I am releasing Falls Area Singletrack (FAST) from liability. This application is a contract with legal consequences. I have been advised to read it carefully before signing. In consideration of the acceptance of my application for entry into the event, or participation in trail maintenance/work activities, I hereby freely agree to and do make the following agreements:

I acknowledge that cycling, and trail work are inherently dangerous activities and fully realize the dangers of participating in the event or trail work activities and fully accept the risks associated with such participation, including by way of example and not limited to, the following: the dangers of collision with pedestrians, vehicles, equipment, tools, heavy machinery, falling debris, unstable terrain, and other cyclists, of conditions, and of the possibility of serious physical and/or mental trauma or injury associated with the event or trail work.

COVID-19: I understand and accept that by participating in this group ride, race, event, or trail work activity. I assume the risk of actual or alleged transmission of a communicable disease such as COVID-19.

For myself, my heirs, executors, administrators, legal representatives, and successors in interest (collectively “successors”) I hereby waive, release, discharge, hold harmless, promise not to sue and indemnify the sponsors of the event, FALLS AREA SINGLETRACK (FAST), ride leaders, co-ride leaders, the organizer and any promotional organization, property owners, law enforcement agencies, all public entities, special districts, properties, and their respective agents, official and employees through or by which the events or trail work activities will be held (collectively, the “released parties”) from any and all rights claims including claims which may hereafter accrue to me and from any and all damages that may be sustained by me directly or indirectly in connection with, or arising out of my participation in or association with the event, trail work activity, or in travel to or return from the event or trail work site.

I agree it is my sole responsibility to be familiar with the race, course, park location, trail work site, area rules and any special regulation for the event or trail work activity. I understand and agree that situations may arise during the race, ride, event, or trail work activity which may be beyond the immediate control of officials or organizers, and I must participate so as to not endanger others nor myself. I accept responsibility for the condition and adequacy of my personal equipment and self. I will ride and/or compete wearing a helmet which satisfies the requirements of ANSI standards and that can protect against serious head injury and assume all responsibility and liability for the selection of such a helmet. When performing trail maintenance or trail work, I will wear appropriate safety gear, including but not limited to, safety glasses, gloves, and sturdy footwear. I will also follow any safety instructions provided by FAST or its representatives. I have no physical or medical condition which, to my knowledge, would endanger others or myself if I participate in this event or trail work activity, or which would interfere with my ability to participate in this event.

By participating in today’s event or trail work activity, I hereby grant Falls Area SingleTrack (FAST) permission to use photographs or videos taken during the event or trail work activity for promotional and marketing purposes. I understand these images may appear on social media, websites, or other media platforms associated with FAST. I waive any rights to review or approve the photos before use.

I agree for myself and my successors that the above representations are contractually binding and are not mere recitals, and that should I or my successors assert a claim in contravention of this agreement, the asserting party shall be liable for the expenses (including legal fees) incurred by the other party or parties in defending, unless the other party or parties are finally adjudged liable on such a claim for willful and wanton negligence. This agreement may not be modified orally, and with any provision herein or as consent to any subsequent waiver or modification.

PARENT OR GUARDIAN WAIVER FOR MINORS (Under 18 years old)

The undersigned parent and natural guardian does hereby represent that he/she is, in fact, acting in such capacity and agrees to save and hold harmless and indemnify each and all of the parties referred to above from all liability, loss, cost, claim or damage whatsoever which may be imposed upon said parties because of any defect in or lack of such capacity to so act and release said parties on behalf of the minor and the parents or legal guardian.
